Each user shall be responsible for the accuracy of the information they voluntarily provide and for their use of the platforms.

It includes, among others, texts, photographs, graphic material, logos, icons, source codes, images, videos, audio, digital downloads and data compilations.

In accordance with article 19 N.º 4 of the Political Constitution of the Republic, Law N.º 19.628 on the Protection of Private Life and its amendments, as well as the other applicable provisions, Latitudes Australes informs of the conditions under which it collects, stores, uses, communicates and retains personal data. This policy also takes into account the entry into force of Law N.º 21.719, on December 1, 2026, without presenting its future provisions as requirements already in force.
The data controller covered by this policy is EL CIGARRAL SpA, RUT 76.589.747-4, owner of the Latitudes Australes brand. The policy also applies to projects marketed under that brand when El Cigarral SpA effectively acts as data controller. Inquiries and requests may be directed to contacto@latitudesaustrales.cl.
The Company may collect information voluntarily provided through the website, Facebook and Instagram advertising forms, information or quote requests, telephone conversations, email, WhatsApp or other enabled channels: first and last name, telephone, email, general location, project of interest, approximate budget, financing preferences, purpose of the search, estimated purchase timeframe and information provided during the commercial assistance. It may also keep the relevant history of inquiries, meetings, visits, proposals, responses and follow-ups.
When they are effectively implemented and their use is appropriate, it may collect technical and interaction data through cookies, browsing records, IP address and advertising measurement tools, in accordance with the relevant authorizations and legal requirements. Collection shall be limited to data that is adequate, relevant and necessary for the informed purposes. No sensitive data shall be requested for ordinary commercial acquisition, unless there is a justified purpose and compliance with the applicable legal requirements.
The data may be processed, according to the applicable legal basis, in order to: (a) respond to inquiries and requests; (b) provide information, quotes and proposals; (c) manage meetings, visits, negotiations and possible real estate transactions; (d) administer commercial relationships and keep the relevant information in CRM systems; (e) segment communications according to interests, projects consulted, preferences, approximate budget and commercial stage; (f) send informational and promotional communications only through the channels and for the purposes that have been validly authorized where applicable; (g) analyze and improve the platforms and the assistance; and (h) comply with legal or contractual obligations and valid requests from competent authorities.
Latitudes Australes may offer users the possibility of voluntarily authorizing the receipt of information, commercial follow-up, news, promotions and content via WhatsApp and email. When the data subject grants prior, free, specific, informed and unequivocal consent for the corresponding channels, the Company may send them, manually or through automated systems:
Communications may be managed through WhatsApp Business, email marketing platforms, CRM systems and other automation tools effectively used by the Company, respecting the conditions of each provider.
Accepting promotional communications is voluntary and does not constitute a requirement to request information, receive a quote or contract products or services. Consent must be obtained through an affirmative and specific action, for example, a voluntary checkbox that is not pre-checked. The mere provision of the telephone number, the general acceptance of these Terms and Conditions or the submission of a form do not replace that specific commercial authorization. The consent shall cover the channels and purposes clearly informed in the text effectively accepted.
Latitudes Australes may organize its contacts by projects consulted, preferences, interests, approximate budget, payment methods, commercial stage and stated purchase timeframe, in order to provide relevant assistance and content. It may use automated systems to classify contacts, schedule communications and organize follow-up tasks, in accordance with the authorizations granted and the applicable legal requirements. These mechanisms do not, by themselves, imply decisions based exclusively on automated processing that produce legal effects or significantly affect the data subject.
The data subject may revoke, free of charge and at any time, their authorization to receive commercial communications, without needing to state a reason. They may reply "BAJA" on WhatsApp, use the unsubscribe link in promotional emails, where it exists, or write to contacto@latitudesaustrales.cl. They may request the suspension of a specific channel or of all commercial channels.
Once the request is received, the Company shall cease the corresponding subsequent promotional sends and update the relevant records to prevent improper re-inclusion. This shall not prevent communications strictly necessary to attend to current requests or to comply with contractual or legal obligations where there is sufficient legal basis. The revocation shall not have retroactive effects.
The Company may keep evidence of the consent effectively granted, including the identity or reference of the contact, date and time of acceptance, platform and form of origin, project consulted, authorized channels, full text of the authorization effectively accepted and current status of the consent. It may keep minimal records of suspension requests to prove their compliance and prevent future unauthorized promotional contacts.
The updating of this policy does not retroactively enable the inclusion of historical contacts in WhatsApp campaigns when they lack sufficient authorization.
Latitudes Australes shall maintain the confidentiality of personal data and shall not sell its databases to independent third parties for their own advertising purposes. It may engage technological providers necessary for web hosting, storage, commercial management, digital advertising, email, messaging and CRM; among them may be Meta Platforms, WhatsApp Business, Google and the providers effectively used. Their intervention must be limited to the applicable purposes and subject to the corresponding legal and contractual obligations. The communication of statistical or aggregated information must avoid the identification of the data subjects when it is announced as anonymized. International processing or transfers of data must be informed and subject to the conditions and guarantees required by applicable legislation. Information may also be communicated when there is a legal obligation or a valid request from a competent authority.
The data shall be retained for the time necessary for the justified purposes, current requests, contractual relationships or legal obligations. The records of potential clients shall be reviewed periodically considering the last significant interaction, the declared purchase timeframe and the validity of the authorizations. When the corresponding purpose ceases, deletion, anonymization or restricted retention measures shall be applied as appropriate. The withdrawal of promotional consent shall entail ceasing that purpose, without prejudice to retaining the minimal records necessary to prove and respect the revocation.
The Company shall adopt adequate and proportionate technical and organizational measures to prevent loss, alteration, unauthorized access, destruction or improper disclosure. Access to personal data shall be limited to the persons and providers who need to know it in the exercise of authorized functions, subject to confidentiality. No system is absolutely infallible, which does not exclude the legal liabilities applicable to the Company.
Users may exercise the rights recognized by Law N.º 19.628 and its amendments, in accordance with its requirements: information and access to personal data, rectification of inaccurate information, deletion where applicable and opposition in the cases established by law. From the entry into force of the relevant provisions of Law N.º 21.719, they may exercise the other rights provided therein, including those of blocking and portability where applicable.
To exercise these rights, they must write to contacto@latitudesaustrales.cl. The Company may require information reasonably necessary to verify the identity of the applicant and shall process their request within the corresponding legal timeframes, without prejudice to the right to apply to the competent authority.
The site may use technical cookies and, when they are effectively implemented, analytics, browsing tracking and advertising measurement tools. Their use must be informed in accordance with applicable regulations, and technologies that require authorization shall be subject to the corresponding mechanisms. Users may manage the available options through their browser or the preferences implemented on the site.
The Company may update this Privacy Policy to adapt it to legal, technological, operational or commercial changes. The current version shall remain published on its website with an update date. If new purposes requiring consent are incorporated, such consent must be obtained beforehand, and the mere publication of a new version shall not replace it.
These Terms and Conditions and the Privacy Policy shall be governed by the laws of the Republic of Chile. Disputes arising from the use of the digital platforms, their validity, interpretation, scope or compliance shall be submitted to the competent courts or bodies in accordance with applicable legislation, without prejudice to the rights of consumers and data subjects and the powers of the corresponding authorities.
Latitudes Australes may modify these conditions, especially when it is necessary to comply with new legal provisions or operational changes. The modifications shall be incorporated into the document published on the official site, indicating the update date and making the additional notices legally required. They shall not be understood as retroactive authorization for processing or communications that require new consent.
Latitudes Australes may disable access for users and edit or delete content that does not respect the foregoing terms, within the limits of current regulations.
